TRIPLE CREEK OUTFITTERS HUNTING CONTRACT

In consideration for Triple Creek Outfitters accepting my application and fee, and being permitted to participate in a hunt with Triple Creek Outfitters, I agree to this release of claims, waiver of liability and assumption of risk, with conditions as follows:

50% Deposit of hunt is due within 10 days after booking your hunt.
Remaining balance due 60 days before the hunt.
Deposit is Non-refundable after April 1st.
Hunts canceled less than 60 days receive no refund.
We cannot assure you a hunt until we receive deposit.
Deer hunt deposit is fully refundable or rolled over to the following year, only if no tag is drawn.
License fees and tags are the responsibility of the hunter.
All prices include lodging, and meals, guide, transportation to and from blind. Tips not included.
No alcohol is provide.
All hunters must provide their own approved safety harness.
Taking a trophy buck is not guaranteed.
Hunter must wear blaze orange (minimum 400 inches) and orange hat, during muzzleloader and rifle season.
Triple Creek Outfitters support buck management and ask hunters to take mature deer only.
Must Book your hunt with Kristy at 620-786-4064 or hunttriplecreek@gmail.com before applying for permit in order to ensure that we have an open date for your hunt.
Triple Creek Outfitters reserves the right to terminate the hunt of any hunter and his/her party for not

complying with or the above stated rules and regulations.

WAIVER OF LIABILITY

I, the undersigned, attest and affirm that I know and understand that the sport of bow and gun hunting is a potentially dangerous activity and that I should not participate in such activity unless I am medically and physically able. I assume all risks associated with participating in a hunt with Triple Creek Outfitters including but not limited to, injuries from falls, injuries from animals, effects of weather, dangerous conditions, or injury resulting from faulty personal equipment and the acts of other hunters.

Having read this waiver and in consideration of Triple Creek Outfitters, accepting my participation in a bow or gun hunt, I hereby waive now and in the future any claims I may have against and release from liability and agree not to sue or allow my executors, heirs or insurers to sue Triple Creek Outfitters, its agents, officers, shareholders, landlords, landowners, or employees from all claims or liabilities for any personal injury, death, property damage, or loss of any kind arising out of my participation in a bow or gun hunt provided by Triple Creek Outfitters, including without limitation, negligence on the part of Triple Creek Outfitters or its staff. Any claims will be settled under Kansas law.

This waiver and release shall be binding upon the undersigned, his/her heirs, executors and assigns or anyone entitled to act on his/her behalf.

I, the undersigned, have voluntarily and without duress signed this WAIVER OF LIABILITY form. I assert that I have read and fully understand the above Waiver of Liability.
